Thanks to SEAL’s immunity deals, confessed killer unlikely to be charged

Special Warfare Operator 1st Class Corey Scott — the SEAL who dropped a legal bombshell on two ongoing war crimes cases by confessing on the stand to asphyxiating an Islamic State prisoner of war — likely won’t face any punishment for the death, according to a copy of his immunity deal shared with Navy Times.

In a dramatic moment during his Thursday testimony, Scott told a packed courtroom at Naval Base San Diego that the man on trial for premeditated murder, Special Warfare Operator Chief Edward “Eddie” Gallagher, the enlisted boss of Alpha Platoon, SEAL Team 7 during a deployment to Iraq two years ago, might’ve stabbed the detainee but he didn’t kill him.

To prevent Iraqi security forces from torturing the boy to death, Scott said, he blocked the seriously wounded teenager’s breathing tube and let him die. He was the killer, not Gallagher.

In Andernach about 50,000 prisoners of all ages were held in an open field surrounded by barbed wire. The women were kept in a separate enclosure that I did not see until later. The men I guarded had no shelter and no blankets. Many had no coats. They slept in the mud, wet and cold, with inadequate slit trenches for excrement. It was a cold, wet spring, and their misery from exposure alone was evident.

Even more shocking was to see the prisoners throwing grass and weeds into a tin can containing a thin soup. They told me they did this to help ease their hunger pains. Quickly they grew emaciated. Dysentery raged, and soon they were sleeping in their own excrement, too weak and crowded to reach the slit trenches. Many were begging for food, sickening and dying before our eyes. We had ample food and supplies, but did nothing to help them, including no medical assistance.

NEW MKULTRA DOCUMENTS POSTED BY BLACK VAULT

The Black Vault filed a FOIA request for all documents pertaining to MKULTRA and related projects back in the late 1990s. Despite the reports that MKULTRA documents were destroyed in 1973, the CIA did locate some files and I was told that these documents were being reviewed. For YEARS I waited, and was never contacted back by the CIA. In time, the CIA DID release the documents on four CD-ROMs. I received these documents back in 2004, and was one of the first (if not the first) to have uploaded the ENTIRE collection of MKULTRA records to the internet.

UN Rapporteur on Torture Nils Melzer Becomes One of Assange’s Most Vocal Advocates

On May 9, UN Rapporteur on Torture Nils Melzer, visited WikiLeaks founder and journalist Julian Assange at Belmarsh Prison, where he is currently serving a 50-week prison sentence for a minor bail violation. Melzer was accompanied by two medical experts who specialize in the examination of possible victims of torture as well as the documentation of symptoms, both physical and psychological. The team was able to speak with Assange and conduct a medical assessment following a set of guidelines known as “The Istanbul Protocol,” a tool designed to help UN workers and others investigate, document, and report incidents of torture and ill-treatment.

The results were shocking.

According to Melzer, the evidence is overwhelming that Assange has been “deliberately exposed, for a period of several years, to progressively [more] severe forms of cruel, inhuman or degrading treatment or punishment,” the effects of which he described as psychological torture.

More Than 500 Torture Cases Documented By UN In Ukraine Conflict

KYIV -- The UN Human Rights Monitoring Mission in Ukraine has documented more than 500 cases of ill-treatment, incommunicado detention, and torture by both Ukrainian government forces and Russia-backed separatists since the conflict erupted in April 2014, the mission’s head said in Kyiv on June 13.

“We believe, however, that this is the tip of the iceberg, as torture is a systemic issue in Ukraine that was exacerbated by the armed conflict,” Fiona Frazer told reporters at a press conference where she presented a new UN report.

In many instances, Frazer said, “the alleged perpetrators are the state security services and the so-called ‘ministries of state security’ of the self-proclaimed Donetsk People’s Republic and the self-proclaimed Luhansk People’s Republic.”

Ukrainian President Volodymyr Zelenskiy, I know you are "juggling a zillion chain saws" right now, as we say in our colloquial English, meaning, you are dealing with a number of crises in Ukraine, and trying to triage them at this moment.

But please, as a human being first, and secondly, as a Ukrainian Jew, who understands the horrific depths of ,"faith based" lethal behaviour inflicted on your ancestors, you have to try to get this madness to stop.

I would like to commend to you a little historical study, about the German Nazi in World War II, who refused to torture his English-speaking prisoners of war. The man's name was Hanns-Joachim Gottlob Scharff.

Between both World wars, Scharff studied English, and had a magnificent grasp of the language.

But rather than use the torture techniques well-known - and used - by the Nazi SS upon their prisoners, Scharff used only kindness, even inviting them out for day passes at cultural events. He was able to convince these prisoners that he already knew everything about them, and their operations, when he really didn't, and was a superb interrogator.

When the war concluded, the US military brass was so completely taken by him, that they invited him to give seminars about how his technique worked.

Because, Mr. President, torture...only gets the tortured person to say whatever his torturers want him to say, to get the torture to stop, even if the information is completely, and horribly, wrong.

So, President Volodymyr Zelenskiy, I - and other thinking Americans - wish (and pray) you "God Speed" on this very tough set of situations you confront, in this "tightrope" walk between Russian, and Western, interests.

And may its resolution come about in a way that is good for all Ukrainians.

Facing the Facts: Israel Cannot Escape ICC Jurisdiction

The Chief Military Advocate General of the Israeli army, Sharon Afek, and the US Department of Defense General Counsel, Paul Ney, shared a platform at the ‘International Conference on the Law of Armed Conflict’, which took place in Herzliya, Israel between May 28-30.

Their panel witnessed some of the most misconstrued interpretations of international law ever recorded. It was as if Afek and Ney were making up their law on warfare and armed conflict, with no regard to what international law stipulates.

Unsurprisingly, both Afek and Ney agreed on many things, including that Israel and the US are blameless in all of their military conflicts, and that they will always be united against any attempt to hold them accountable for war crimes by the International Court of Justice (ICC).

On a recent trip to the museum I picked up on many subtle–and not so subtle–messages to valorize the deeply problematic deeds of secret intelligence agencies.

It is unfortunate that with the Senate having backed Gina Haspel as director of the CIA, means that this agency will probably still torture, or outsource torture, as a way of allegedly "gathering intelligence".

The problem is, that torture does does not work; because the dynamic of this process is, that the tortured person will say ANYTHING, no matter how flatly wrong, to get the torture to stop.

FBI gets an unexpected lesson from a former interrogator for the Nazis

Between the two wars, he learned English brilliantly, and was interrogating English, and American POWs, but not one bit of brutality was ever used. His technique has to get the prisoner to think that he already knew everything about the operations in which they were involved. He even, on occasion, took them out with a "day pass" for a cultural or artistic event. He knew how to get people he interrogated feel at ease, and somehow, something popped out of their mouths which gave him more insight into what they were really doing.

He was so respected, that after the war, the American military invited him to teach their people how to do what he had done; he later moved here, and became a pottery artist.

It is unfortunate that the American military has forgotten this very decent man and his techniques; this man had to have had a very high moral character, NOT to do what his fellow interrogators were doing, in terms of not beating, strangling, or tearing out fingernails.

Julian Assange’s case goes even farther than breaking all the rules of “democratic” free speech. The way he is treated is a serious infraction on Human Rights. UN Special Rapporteur on torture Nils Melzer has said that on the 31st of May he gave video interviews with both Sky News and the BBC on his findings that WikiLeaks founder Julian Assange is the victim of psychological torture.

As of this writing, footage of those interviews is nowhere to be found.

U.S.-LED COALITION ADMISSION OF 1,300 CIVILIAN DEATHS IN IRAQ AND SYRIA

Responding to today’s announcement by the U.S.-led Coalition that at least 1,302 civilians have been unintentionally killed by Coalition strikes in Syria and Iraq between August 2014 and the end of April 2019, Amnesty International’s Senior Crisis Response Adviser Donatella Rovera said:

“While all admissions of responsibility by the U.S.-led Coalition for civilian casualties are welcome, the Coalition remains deeply in denial about the devastating scale of the civilian casualties caused by their operations in both Iraq and Syria.

“A comprehensive investigation by Amnesty International in partnership with Airwars, launched last month, revealed that more than 1,600 civilians were killed in the Raqqa offensive alone in 2017 – meaning the acknowledged deaths are just a fraction of the total numbers killed.

Every time I see an image of a dead, or dying child, courtesy of US-enabled, or US-generated air strikes, I just want to grab that kid, just reach through the computer screen, and pull him or her out of that horrific situation, and into my arms, to at least provide some tiny bit of human compassion before they pass.

And I am about to do what some of you hate me for doing, posting some images of human beings killed, or crippled for life, courtesy of this government, which has chosen not to represent me, or many other people in this country who have an intellectual grasp of what is coming next.

But that is exactly what happened. Now, after three years, the disturbing video has been released and the taxpayers, not the cop who did most of the torturing, are being held liable.

On Thursday, Wilson received more than $500,000 as part of a settlement reached with the county.

Judge in war crimes case against Navy SEAL weighs dismissal motion

The judge in the court-martial of a Navy SEAL platoon leader accused of war crimes in Iraq is weighing defence motions to dismiss the charges or otherwise remove the lead prosecutor and possibly the judge himself from the case.

Arguments on the motions, based on defence accusations of prosecutorial misconduct, were originally slated for Wednesday, but the judge postponed the proceeding until Thursday at the request of the defence.

The hearing comes 11 days before Special Operations Chief Edward Gallagher is due to go on trial charged with killing a helpless, wounded Islamic State fighter in his custody and of shooting two unarmed civilians, a schoolgirl and an elderly man.

Pardoning War Criminals Is a Monstrous Way to Honor Memorial Day

How are you spending Memorial Day? Ordinary people may attend parades, host cookouts, or take the long weekend to visit loved ones.

Donald Trump, on the other hand, may pardon a few war criminals.

The president recently requested the files of several accused and convicted U.S. war criminals, a possible step toward expedited pardons for individuals who’ve done unspeakable things.

There’s SEAL chief Edward Gallagher, who senselessly shot to death a teenage girl and an elderly man in Iraq. Gallagher also brutally stabbed a wounded 15-year-old to death – and then posed for photos with the body, which he texted to friends.

Trump also requested the files of Nicholas Slatten, a Blackwater contractor convicted of shooting dozens of Iraqi civilians in the notorious 2007 Nisour Square massacre, and of Mathew Golsteyn, who confessed to murdering an unarmed Afghan captive US soldiers had released.

UN TEAM UNEARTHS 12 MASS GRAVES OF EZIDIS IN IRAQ

A United Nations team investigating the massacre of Ezidis and other atrocities has unearthed 12 mass graves in Iraq, AFP reported on Tuesday (May 21).

British lawyer Karim Asad Ahmad Khan said in a UN report sent to the Security Council said efforts were focused on three initial investigations: the 2014 massacre of Ezidis, crimes committed in Mosul from 2014 to 2016, and the mass killing of Iraqi military recruits in the Tikrit area in June 2014, according to AFP.

The UN Security Council agreed in 2017 to establish the UN probe to ensure Islamic State (ISIS) faces justice for war crimes in Iraq and Syria.

The team began work in October with the first mass grave containing ISIS victims uncovered in March and April the village of Kocho in Sinjar. Kocho is located 20 kilometers from Sinjar and many of its residents were killed or abducted when ISIS militants attacked.

War Crimes Pardons: A Terrible Memorial Day Idea

On May 16, 2008, near the town of Baiji in Iraq, 1st Lieutenant Michael Behenna, US Army, murdered a prisoner. That was the verdict of the jury in his 2009 court martial, anyway. He was sentenced to 25 years in prison, but paroled in less than five. On May 6, 2019, US president Donald Trump pardoned Behenna.

As I write this, news reports indicate that Trump intends to celebrate Memorial Day by pardoning several other Americans convicted of (or accused of and not yet tried for) war crimes in Iraq and Afghanistan. That’s a horrible idea for several reasons.

One reason is that it’s morally repugnant to excuse the commission of crimes, especially violent crimes, for no other reason than that the criminal is a government employee.

A second reason is that it is detrimental to the good order and and discipline of the US armed forces to excuse violations of law by American soldiers, sailors, airmen, and Marines.

Retired USAF lieutenant colonel Karen Kwiatkowski writes in an article posted at Lew Rockwell’s website that Julian Assange is receiving the same treatment as suspected terrorists while in captivity at “Her Majesty’s Prison Service” at Belmarsh.

The FBI, Pentagon, and CIA are “interviewing” Assange. Kwiatkowski writes:

Interviewing is the wrong word. I’d like to say doctoring him, because it would be more accurate, except that word implies some care for a positive outcome. Chemical Gina has her hands in this one, and we are being told that Assange is being “treated” with 3-quinuclidinyl benzilate, known as BZ.

Blackwater Starts Training of ISIL Terrorists at US Base in Western Iraq

The notorious US mercenary firm Blackwater has returned to Iraq to train thousands of ISIL terrorists in the Washington-occupied Ein al-Assad base in al-Anbar province, a Lebanese newspaper reported.
The Arabic-language al-Akhbar newspaper reported on Saturday that Blackwater, along with other security firms, has returned to Iraq since the start of 2018 after Washington's heavy pressures on Baghdad to issue a relevant license.

According to the report, a source close to the US charge de affairs in Iraq Judy Hood said that Blackwater has transferred the US military equipment from Jordan to Western al-Anbar province in full coordination with Ein al-Assad base, adding that the company is now training the ISIL terrorists in the base.

Facebook says it will allow Holocaust denial

We do not remove lies or content that is inaccurate," wrote Joel Kaplan, Facebook's vice president of global public policy.

(JTA) — Facebook will still allow users to deny the Holocaust even though it removed prominent bigots and anti-Semites from its platform.

The social media giant deleted the personal, professional and fan accounts of some leading extremists and conspiracy theorists, like David Duke, Louis Farrakhan and Alex Jones, on Thursday. But in a letter from April 9, Joel Kaplan, Facebook’s vice president of global public policy, said the site would still allow users to “say things on Facebook that are wrong or inaccurate, even when they are offensive.”

Webmaster's Commentary: 

This demonstrates, painfully clearly, that Facebook was after those people deemed "leading extremists and conspiracy theorists", so they were summarily deplatformed.

This was about getting those people off its site, rather than Holocaust denial, they were after, and this was simply the justification.

As Facebook continues with these policies, there is going to be a very rocky road between this blog... and those who believe that the First Amendment to the Constitution is granted to every American, even if one believes that what they are saying is flat-out wrong.

A former US Marine was arrested in connection with an "especially violent" raid on the North Korean embassy in Madrid, Spain.

The one-percent doctrine went like this: If there was even a one-percent chance that a terrorist or other American enemy could pull off another 9/11 — or worse — the United States had to commit 100 percent of its time, capabilities, and efforts to thwarting that one-percent threat, no matter the cost. According to this view, despite the existence of a massive, entrenched defense and intelligence bureaucracy, the United States missed the warning signs of 9/11. Cheney worried about what else America’s elite institutions could be missing. The one-percent doctrine was Cheney’s best solution for ensuring another devastating attack did not surprise the United States.

ICC rejects request to investigate war crimes in Afghanistan

The International Criminal Court (ICC) has rejected its prosecutor's request to investigate alleged war crimes in Afghanistan.

Court judges highlighted instability and the lack of co-operation with investigators in the country.

The ruling was hailed by US President Donald Trump as a "major international victory" but human rights group Amnesty International criticised it.

It comes a week after the US revoked ICC prosecutor Fatou Bensouda's visa.

The ICC judge claimed a lack of evidence and a poor outlook for state cooperation — the latter reason essentially meaning the US and UK have already condemned the prospect of opening such an investigation.

The ICC had previously vowed to continue to operate "undeterred" by any US threat of punitive action against the ICC when it first considered examining allegations that US personnel committed war crimes, including instances of unlawful detention and torture of Afghans, as well as killing of civilians. The window of time ICC prosecutors considered for their investigation ran from May 2003, within the opening years of the US occupation, to 2017.

“The chamber hereby decides that an investigation into the situation in Afghanistan at this stage would not serve the interests of justice and accordingly rejects the request,” the judges said in their decision, as cited by Reuters. But the obvious first question is: whose interests are being served here?

A Failed State Called Libya

New reports suggest forces loyal to Libya’s Tripoli government have recaptured the former international airport in the south of the capital from eastern forces. This is while clashes are still ongoing in the Qasr ben Ghashir area next to the airport.

This comes after an increase of fighting and violence in Libya, as rival factions contending to be the country's legitimate government drag out a prolonged conflict. Leading the military, General Khalifa Haftar has vowed on an assault on Tripoli, the country's capital city and seat of the administration backed by members of the United Nations Security Council. Western nations have called for the fighting to stop, accusing the marshal of launching an illegitimate and undemocratic coup.

Libya's problems aren't new or even surprising. They are all an extension of a catastrophic foreign policy decision made at the beginning of this decade, which is to have violently overthrown Muammaoutr Gaddafi and to have plunged the country into a crisis it has not recovered from.

The army behind Libya's UN-backed government has announced a counteroffensive to defend Tripoli, vowing to reclaim all areas seized by forces loyal to renegade General Khalifa Haftar, who have been marching on the outskirts of the capital.

Colonel Mohamed Gnounou told reporters in Tripoli on Sunday that the counteroffensive, dubbed "Volcano of Anger", was aimed at "purging all Libyan cities of aggressor and illegitimate forces".

The announcement came as Haftar's forces said they conducted the first air raid on a Tripoli suburb as part of their aim to overthrow the internationally-recognised Government of National Accord (GNA) and control Tripoli.

The alleged attack came after GNA forces launched air raids on Haftar's self-styled Libyan National Army (LNA) around 50km south of Tripoli on Saturday, reportedly killing one person.
