The U.S. Supreme Court recently ruled that the Department of Health and Human Services violated drug reimbursement rules for low-income patients.
The court unanimously ruled that HHS, which is led by former California Attorney General Xavier Becerra, illegally cut prescription drug reimbursements to hospitals by $1.6 billion per year in connection with a program that was established to help poorer patients.
The decision is considered a victory for hospitals that serve low-income patients and will now allow them to seek the funds they were denied by Becerra’s agency.
But HHS improperly relied on a formula that Congress made available only in specific circumstances, which didn’t apply in the case, the court determined. President George W. Bush in 2003 signed the Medicare Prescription Drug, Improvement, and Modernization Act into law. The statute requires HHS to establish reimbursement rates every year for certain outpatient prescription drugs provided by hospitals using a predetermined formula.

A House Democrat blasted House Speaker Nancy Pelosi on Friday for a "failure of House leadership" by refusing to call up legislation to impose tougher stock trading restrictions on members of Congress.
Rep. Abigail Spanberger, D-Va., said she has been working with members since 2020 to call up a bill that would strengthen the provisions of the STOCK Act, a 2012 law that prohibits lawmakers from using inside information to profit from stock trading. Support for a complete ban on trading by lawmakers grew this year, but Spanberger accused Pelosi, D-Calif., and other Democratic leaders for shutting it down.
"[A]fter first signaling her opposition to these reforms, the Speaker purportedly reversed her position," Spanberger said. "However, our bipartisan reform coalition was then subjected to repeated delay tactics, hand-waving gestures, and blatant instances of Lucy pulling the football."
On Thursday, California Governor Gavin Newsom signed into law a piece of legislation that will designate the state as a sanctuary for children and teens seeking medicalized gender transitions.
Newsom’s signature on the bill, SB 107, comes nearly a month after the California legislature passed State Senator Scott Wiener’s bill, which was introduced in 2021.
The bill allows families or individual minors who traveled to the state for the purpose of these medical procedures to be safe from out-of-state authorities acting on subpoenas, warrants, and child custody issues if the minor was brought into the state for procedures like surgical gender reassignments or the prescribing of cross-sex hormones.
The bill would also "prohibit law enforcement agencies from making, or intentionally participating in, the arrest of an individual pursuant to an out-of-state arrest warrant based on another state’s law against receiving or allowing a child to receive gender-affirming health care."

The US stands to benefit economically from the attack on the Nord Stream gas pipelines and has a record of targeting energy infrastructure with sabotage operations, the head of Russia’s Security Council said.

On Thursday, President Biden took a short trip to the FEMA headquarters to give remarks on the federal response to Hurricane Ian and meet with FEMA Administrator Deanne Criswell. Following his remarks, Biden turned and saunted away from the podium...in the wrong direction as his FEMA chief called after him to try and put him back in the correct direction.
